Acreus provides a real estate intelligence platform that enables users to search properties, access property-related data, generate reports, and manage deal pipelines. The Service aggregates publicly available information and third-party data sources to provide property intelligence.
The information provided through the Service is for informational purposes only and should not be relied upon as the sole basis for any real estate, investment, legal, or financial decisions. Users should independently verify all information and consult with qualified professionals before making any decisions.
3. User Accounts
To access certain features of the Service, you must create an account. You agree to:

The Service incorporates data from third-party sources including but not limited to public records, mapping services, and data providers. We do not control, endorse, or assume responsibility for any third-party content or services. Third-party data is provided “as-is” and may contain errors, omissions, or inaccuracies.

7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS; OR (E) ANY INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT.
WE EXPRESSLY DISCLAIM ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY PROPERTY DATA, ZONING INFORMATION, MARKET ANALYSIS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACREUS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of profits, revenue, data, or business opportunities
- Loss of goodwill or reputation
- Cost of procurement of substitute services
- Any damages resulting from unauthorized access to or alteration of your data
- Any damages resulting from security breaches, hacking, or cyber attacks
- Any damages resulting from interruption or cessation of service
- Any damages resulting from third-party conduct or content
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. Data Security and Cyber Incidents
While we implement reasonable security measures to protect your data, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee the absolute security of your information.
YOU ACKNOWLEDGE AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY UNAUTHORIZED ACCESS TO, ALTERATION OF, OR THE DELETION, DESTRUCTION, DAMAGE, LOSS, OR FAILURE TO STORE ANY OF YOUR DATA OR OTHER INFORMATION, WHETHER RESULTING FROM SECURITY BREACHES, CYBER ATTACKS, HACKING, MALWARE, OR OTHER MALICIOUS ACTIVITIES.
In the event of a data breach affecting your personal information, we will notify you in accordance with applicable law but shall not be liable for any damages, losses, or consequences arising from such breach.
10. Indemnification
You agree to defend, indemnify, and hold harmless Acreus and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights
- Any content you submit or transmit through the Service
- Your negligent or wrongful conduct
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
All provisions of the Terms which by their nature should survive termination shall survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Acreus regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements, communications, and proposals.
15. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Acreus.
